




Your first placement establishes a partnership between you and Tempo-Team Luxembourg which we hope will become an enduring and mutually fulfilling enterprise.
Length of placement
The duration of placements depends on the needs and circumstances of the employing company: temporary increases in activity, replacement of employees, seasonal activity…
Nevertheless, under Luxembourgish law, the length of a placement contract cannot exceed 12 months for the same post, including renewals of contract.
Test period
Placement contracts include a ‘test period'. During this time, while paid at the normal rate, either you, or Tempo-Team Luxembourg, are able to terminate the placement without prejudice to the agreement between you and Tempo-Team Luxembourg.
The test period is :
- 3 days if the contract is for less than or equal to 1 month.
- 5 days if the contract is for between 1 and 2 months.
- 8 days for contracts beyond 2 months.
At the end of the test period, you will have the opportunity to discuss your progress and views with Tempo-Team.
At the end of a placement, you are also encouraged to provide an evaluation of the placement to Tempo-Team Luxembourg.
Breach of contract
Once the test period has been completed, both you and Tempo-Team are bound to the placement contract.
If you terminate the placement prematurely (before the agreed term), you are liable to a claim of compensation against you.
Similarly, if we terminate your contract before the agreed term (except for reasons of grave misconduct, or for reasons of force majeure) we must provide you, within 3 working days, with a placement of similar terms (qualification requirements, remuneration, hours of work and distance of travel, etc) for the period of the existing contract.
If the duration of the existing contract is greater than 4 weeks, we can propose you for up to three successive placements. If we fail to place you, we must pay you your anticipated wages based on the remainder of the existing contract.
Your placement
Each placement is chosen for you according to your competencies, interests, experience, proximity to where you live, and your availability.
When your agency proposes a placement, they will describe the tasks to be carried out and the work environment, as well as advise you of the method of recruitment. We hope this enables you to make informed decisions in an involved process.
During a placement, you are subject to the work conditions of the business (weekends and holiday arrangements, hours of work, health, safety and security, medical supervision, etc…), just like for permanent staff. You will have access to the canteen (if appropriate), and to various company equipment. Your agency will contact you in order for you to sign the placement contract.
In case of absence or illness, you must inform us immediately and may be required to obtain and provide us with a doctor's note within 48 hours.
Your pay
How am I paid?
By your employer – Tempo-Team Luxembourg. Tempo-Team is your employer and we will pay your wages directly.
Your hourly wage will be based on the reference rate, as determined by the company where you are placed.
Important! In order to process your pay, the agency will need a completed record of hours work by the weekend. Records of hours worked must be signed and verified by the company where you are placed.
You will normally be paid by the 10th day of the month.
Additional allowances:
Holidays: bank holidays are permitted under the same conditions which apply to permanent employees.
Overtime: Overtime beyond the statutory limit (48 hours per week) will be paid at a higher hourly rate, or will entitle you to time off in lieu of the additional time worked.
Accrual of paid holiday: An allowance of paid holiday will be provided if you if do not have the opportunity to take holiday during your placement.
Other allowances, such as for meals and travel, may be available depending on the conventions of the business where you are placed.
Social Security protection
As for all employees, you will benefit from Social Security and any entitlement to family benefits, sickness benefits, maternity benefits, disability benefits, life insurance and old-age provision.
You are naturally entitled to those Family benefits (reimbursement of medical and paramedical costs) which you normally claim through your existing insurance office at your place of residence. You will therefore be able to maintain your existing medical services (doctor, pharmacist, dentist, etc…) and to claim any expenses in the normal way.
Financial compensation for illness: in case of incapacity due to illness or prolonged disease, an accident or pregnancy, sickness insurance guarantees compensation for loss of earnings.

Family Benefits
If you have at least 1 child, you may, under certain conditions, be entitled to claim Luxembourgish Family benefits, irrespective of your position in the family.
Depending on your employment status, you may benefit from direct payment by the Luxembourgish National Cashier for Family Benefits for the entirety of the allowance, corresponding to the payments you would normally receive from the Social Security office in your country of residence.

Health and safety
As for all employees, you will be required to undertake a medical check in order to determine your ability to undertake the work proposed. This may be a medical examination prior to the commencement of your placement, an annual medical check-up, return visits (following the end of your placement), or special medical supervision (if, for example, during the course of your placement, you are likely to be exposed to certain risks). All such checks are mandatory. Failure to comply would prevent your candidacy for the placement from proceeding, or could lead to your placement being terminated.
If you have a concern or question regarding safety at work, you should raise it officially with your agency. At all times, you must respect the safety procedures of the business in which you are placed. If you are required to work in an environment where you may be exposed to special risks, you may be required to adhere to a rigorous standard of safety – this will be ultimately for your own benefit. Further, if your placement necessitates the wearing of protective equipment or clothing (helmet, boots, gloves, goggles…), such equipment or clothing will be provided to you by the company, or by Tempo-Team Luxembourg.
As your employer, Tempo-Team has the means to intervene when dangerous practices or workplaces are reported. Safety is a major priority for Tempo-Team .
If you feel in grave and imminent danger during your placement, you have the right to withdraw from the post. In so doing, you must inform your superiors, as well as the agency, explaining your reasons and concerns.
